This privacy notice describes how we collect and use the personally identifiable information you provide on our websites linked to this Privacy Policy and on our mobile applications. It also details the options available regarding how we use your personally identifiable information and how you can access and update such information.

Personally identifiable information (also known as "personal data") refers to any data about you that can be used, directly or indirectly, to identify you (e.g., name, address, phone number, date of birth, email address, etc.). Data that cannot be used to identify you, such as anonymous data, is not considered personally identifiable information.

1. GENERAL INFORMATION

Bizplin provides you with a list of definitions for terms that will be used in the development of this privacy notice:

Cookies. – Small pieces of information from a website that are stored on the hard drive of the device used to connect to the Internet, through the browser at the request of the website server.

IP Address. – The numeric logical identifier of the device used to connect to the Internet, assigned by the Internet service provider when a user connects.

Domain Name. – Represents a common identifier for a group of computers or devices connected to the network. They are a simple form of Internet address designed to allow users to easily locate websites on the Internet.

Whois. – A database system used to query Domain Names and their personal data, as well as to check and verify ownership and the assignment of Internet Resources.

 

2. Privacy Officer and Contact Information

At Bizplin, we are committed to the security of our customers. Therefore, we inform you that we have a Privacy Officer who is the person within Bizplin designated to:

Address requests for the exercise of your rights.

Promote and ensure the protection of personal data processed by Bizplin.

In compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties.

3. Personal Data Collected for Processing and Methods of Collection

The personal data we collect from you for the purposes described in section 8 of this privacy notice is collected directly when you enter your data through our online portal, and when we obtain information through publicly available sources, as well as personal data received from transfers permitted by the Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, guidelines, and other applicable provisions.

The personal data we collect from you directly through our online portal includes the following:

  • First and Last Name.
  • Business name or trade name.
  • Home/office/cell phone number.
  • Email address.
  • Address.
  • Postal code.
  • Current official ID (only in cases where fraud is suspected and/or rights are exercised).

The personal data you provide to us directly will be processed lawfully and solely for the purposes described in this privacy notice. Furthermore, to protect your personal data, we will establish administrative, technical, and physical security measures to safeguard your personal data against damage, loss, alteration, destruction, or any use other than that indicated in this privacy notice.

 

4. Personal Data of Minors and Persons Under Legal Incapacity

We inform you that it is of particular interest to us to protect the privacy of your personal data. The services offered by Bizplin are not intended for, nor can they be contracted by, minors under eighteen (18) years of age, or persons under legal incapacity according to Mexican laws.

Any data related to the aforementioned individuals must be provided to Bizplin by the minor’s or person under legal incapacity’s parent or guardian, in accordance with the provisions of this privacy notice.

If you intend to provide personal data of minors and persons under legal incapacity, you must send an email to the following address: privacidad@bizplin.com. Once we receive your request, our Privacy Officer will contact you to provide further instructions.

 

5. Personal Data of Third Parties

If the client provides third-party personal data to Bizplin, the client must have the express consent of the data subject beforehand, and must also inform them of the location where they can find and review Bizplin’s privacy notice.

 

6. Sensitive Personal Data

Bizplin DOES NOT COLLECT OR RECEIVE SENSITIVE PERSONAL DATA, as they are not required for the fulfillment of the services we provide.
Additionally, we DO NOT COLLECT CLIENT FINANCIAL INFORMATION.

We only receive a Payment Notification, which contains:
Client’s full name.
Email address.
Amount.

For more information regarding payments made through a payment service company, please refer to the privacy notice and privacy policies applicable to that company.

 

7. Purposes of Collected Personal Data

Your personal data is collected for two purposes:

Primary Purposes: Purposes that are necessary for the existence and fulfillment of the services offered by Bizplin®, including:

  • Providing web development, e-commerce, and online marketing services.
  • Identifying you before, during, and after the provision of services.
  • Providing notification services related to the contracted service.
  • Billing for the contracted services.
  • Registering domain names on behalf of the client when required by Internet Corporation for Assigned Names and Numbers (ICANN) and Network Information Center Mexico.
  • Performing demographic analysis.
  • Conducting risk analysis.

Secondary Purposes: Purposes that are not essential for the existence of the legal relationship but are of significant importance and use to provide the services, including:

  • Offering products, services, and promotions.
  • Conducting marketing studies.
  • Carrying out advertising studies.
  • Commercial prospecting.
  • Providing information about our services.

 

8. Denial of Personal Data Processing for Secondary Purposes

If you do not wish your personal data to be processed for the secondary purposes mentioned, or any of them, you can deny us your consent from this moment by sending your request to our privacy officer, who will guide you through the procedure to exercise your right. Your denial in this regard will not be a reason for us to deny you the services and products you request or contract with Bizplin.

When we obtain personal data indirectly, you will have a period of 5 business days to express your denial for the processing of personal data for secondary purposes. If you do not do so, it will be understood that you consent to the processing of personal data for secondary purposes, without prejudice to your later decision to exercise your rights of revocation or opposition under this privacy notice.

 

9. Means and Procedure for Exercising ARCO Rights

Under the applicable regulations, you have the right to know what personal data we process, for what purposes we use them, and the conditions of their use (Access). You also have the right to request the correction of your personal information if it is outdated, inaccurate, or incomplete (Rectification); to have it deleted from our records or databases when you consider it is not being used properly (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

To exercise any of the ARCO rights, you must submit the respective request via email to our privacy officer, who will inform you about the procedure and requirements to exercise these rights, response times, the way we will enforce your right, and will address any questions, complaints, or comments you may have regarding this matter.

 

10. Mechanisms and Procedure to Revoke Your Consent

Under the applicable regulations, you can revoke the consent you have granted to us. However, it is important to note that this may not be applicable in all cases, as we may be required to continue processing your personal data in whole or in part due to a legal obligation.

To revoke your consent, you must submit your request via email to our privacy officer, who will inform you about the procedure and requirements for exercising this right, response times, the way we will enforce your right, and will address any questions, complaints, or comments you may have regarding this matter.

 

11. Options for the Data Subject to Limit the Use or Disclosure of Their Personal Data

At any time, you may limit the consent for the use and disclosure of your personal data through mechanisms other than the exercise of ARCO Rights, by expressing your refusal to allow the use of your personal data for receiving advertisements related to Bizplin, by sending an email to our privacy officer at privacidad@bizplin.com, who will inform you of the procedure to follow to exercise your right.

 

12. Use of Cookies, Web Beacons, or Other Similar Technologies

Cookies are text files that are automatically downloaded and stored on the user’s computer hard drive when navigating a specific website, which allow the website server to remember some information about the user, including their preferences for viewing pages on that server, name, and password.
